By accessing or using HabShare (“we,” “our,” or “the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
1Description of Service
HabShare provides an online image hosting and sharing platform that allows users to upload, store, and distribute image files.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
2Eligibility
By using HabShare, you represent that:
- You are at least 13 years old (or the minimum legal age in your jurisdiction).
- You have the legal authority to agree to these Terms.
- You will comply with all applicable laws and regulations.
3User Responsibilities
You are solely responsible for:
- The content you upload.
- Ensuring you have the necessary rights, licenses, or permissions to upload and share images.
- Compliance with all applicable local, national, and international laws.
You retain ownership of your content. However, by uploading content, you grant HabShare a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.
4Prohibited Content
You may not upload, share, or distribute images that:
- Infringe or violate copyrights, trademarks, patents, or other intellectual property rights.
- Contain pornography or explicit adult content.
- Contain child sexual abuse material (CSAM) or exploit minors in any way.
- Contain non-consensual intimate images (“revenge pornography”).
- Depict extreme violence, gore, mutilation, or deceased individuals in a graphic manner.
- Violate an individual's privacy or publicity rights.
- Are illegal under applicable law.
- Are deceptive, malicious, hidden, transparent, or designed to abuse system functionality.
- Contain malware, malicious code, or attempt to compromise system security.
HabShare reserves the right to remove any content at its sole discretion.
5Content Moderation and Enforcement
HabShare may:
- Remove, disable, or restrict access to any content that violates these Terms.
- Suspend or terminate user accounts without prior notice.
- Report unlawful content to appropriate law enforcement authorities.
We reserve the right to take action against content that may compromise the security, performance, or integrity of our systems.
6Copyright & DMCA Policy
HabShare respects intellectual property rights.
If you believe your copyrighted work has been uploaded without authorization, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice.
Upon receiving a valid DMCA notice, we will remove or disable access to the allegedly infringing material in accordance with applicable law.
Repeat infringers may have their accounts permanently terminated.
7Image Retention & Deletion Policy
HabShare reserves the right to delete images:
- That violate these Terms.
- That have not been accessed for an extended period.
- That have minimal or no activity.
- For storage management, operational, or legal reasons.
We do not guarantee permanent storage of any content.
8Service Availability
We do not guarantee uninterrupted, secure, or error-free operation of the Service. We are not liable for:
- Data loss
- Service outages
- Security breaches
- Indirect, incidental, or consequential damages
Use of the Service is at your own risk.
9Limitation of Liability
To the maximum extent permitted by law, HabShare and its operators shall not be liable for:
- Loss of data
- Loss of profits
- Business interruption
- Indirect or consequential damages arising from use of the Service
10Termination
We reserve the right to suspend or terminate access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the platform or its users.
11Modifications to These Terms
HabShare reserves the right to modify or update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
12Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the United States, without regard to conflict of law principles.
